1.1 “Holiday” means the duration of stay in any accommodation provided or supplied by Project Ski Ltd.
1.2 “Terms and Conditions” means the terms and conditions set out in this document together with any other terms agreed in writing.
1.3 “Client” means the person detailed as the lead passenger and with whom Project Ski Ltd. form a contract.
1.4 “Guest” means any other person named on the booking.
1.5 “Force Majeure” means an event beyond Project Ski Ltd.’s control, including (but not limited to) an act of God, civil disorder, war or military operations, terrorism or threat of terrorism, national or local emergency, acts or omissions of government, industrial disputes, fire, flood, weather or natural disaster, any other act or omissions of persons for whom Project Ski Ltd. is not responsible, or events which are unforeseeable and could not have been reasonably avoided.
1.6 “In writing” means any form of written communication including by electronic means.
1.7 “Late booking” means any booking made within 10 weeks of the date on which the reservation commences.
2.1 A contract between the Client and Project Ski Ltd. is deemed only to exist once the client has agreed to these Terms & Conditions and a non-refundable deposit has been received by Project Ski Ltd. and a confirmation invoice has been issued.
2.1.1 For all late bookings, a contract exists from the moment the balance payment has been processed and verbal confirmation given. Telephone bookings in late circumstances, still require all guest details to be given but it is deemed that these terms and conditions have been viewed and accepted at the time the booking is made.
2.2 Confirmation of your booking and receipt of any payment made will be via email unless requested otherwise. When you receive your invoice and confirmation, please ensure all details are correct as the invoice together with these booking conditions form the basis of the contract between us. Any discrepancies should be bought to our attention within 7 days of the invoice being issued; otherwise it will be assumed that all information is correct.
2.3 The person who made the booking will be deemed as the lead passenger and is liable for that booking even if other names exist on the form.
2.4 All accommodation must be booked in full and all beds paid for even if the number of passengers is less than the maximum occupancy of the accommodation.
2.5 Accommodation will be reserved for the Client between the dates agreed and outlined on the invoice. The Client may access accommodation from 5pm on the day the holiday commences and must depart no later than 10am on the end date of the holiday. We may, on request, be able to offer earlier access but can not guarantee this.
2.6 Pets are not permitted in any accommodation without obtaining prior permission in writing from Project Ski Ltd.
2.7 Smoking is prohibited in all accommodation
2.8 Insurance: It is a condition of your booking that all guests have full holiday insurance including cancellation, medical, winter sports and third party cover. All personal belongings of the client and ski equipment hired by the client are their sole responsibility.
3.1 A non-refundable deposit of 25% of the total cost is required to secure your booking. This must be paid in £ sterling and is not deemed to have been paid until all funds are cleared in our bank account.
3.2 Full payment of any outstanding balance is due 10 weeks before (known as the due date) the commencement date of your reservation or at the time of booking for all bookings made within 10 weeks of the commencement date. Due dates for final balance payments are confirmed in all written communication confirming your booking.
3.3 Payment can be made by bank transfer (please request details), cheque (payable to Project Ski Ltd. and sent to Lodge Orchard, Doddington, Sittingbourne, Kent ME9 0HG), credit or debit card. Please note, payment by credit card will incur a 2.5% surcharge to cover the cost of processing credit card payments. The cost of any bank charges is the Clients responsibility and will be deducted from the payment amount received.
3.4 If payment is not received by the due date, Project Ski Ltd reserve the right to cancel your booking and retain your deposit.
3.5 The Client is liable for payment.
3.6 For all bookings, a hold of between £500 and £1000, depending on the property, will be placed on the Client’s bank card at the time of check in. The cost of any expenses incurred as a result of damage caused by the Client will be taken from the held amount within 7 days of check out. The hold will then be cancelled. If no costs are incurred, the hold will be cancelled with in 3 days of check out.
4.1 The price quoted for accommodation rental includes 7 nights accommodation (unless stated otherwise) and any other service detailed as included on our website or made in writing. Local resort tax is not included in the price and will be added to your invoice.
4.2 The price quoted for any catering service includes the services of our staff, cost of food and beverages as detailed on our website or as agreed in your proposal form and housekeeping for 6 days per week.
4.3 Any price offered does not include:
- Travel to and from the UK
- Transfers to and from the resort
- Travel and Holiday insurance
- Ski pass, equipment rental and lessons
- Local resort taxes
- Bank and credit card charges
- A damage deposit of £500 – £1000 which will be taken at the time of arrival in resort.
4.4 All children are entitled to a discounted rate for catering services provided they opt for the childrens menu and earlier tea. A child is deemed to be between the ages of 2 and 18 years old. There is a charge of £100 per week for any infant aged 2 or under. This charge is for the provision of a highchair and cot with linen as well as food and milk.
4.5 Although every effort is made to ensure that prices are accurate at the time of publication we cannot guarantee these prices and you must check the price of your chosen holiday at the time of booking, at which point the correct current price will be advised to you.
4.6 Project Ski Ltd. reserve the right to adjust any prices before your booking is confirmed. Once a booking has been accepted, we reserve the right to levy surcharges in the event of changes to the Company’s costs in dues, taxes, fees payable or in relation to the exchange rates that have been used to calculate the costs of your booking. You will be entitled to cancel your booking in such circumstances and receive a full refund provided that you do so within 14 days of the invoice being issued. Surcharges will not be enforced if the due date has passed and the final balance has been paid.
5.1 To make changes to a booking, the Client must inform us as soon as possible and confirm the details in writing. We will try to avoid charges for amendments but you will be liable for any increased costs resulting from changes made.
5.2 We will notify you in writing of any amendments that Project Ski Ltd. are required to make to your booking.
6.1 The Client or any guest is entitled to cancel their booking, subject to the terms of Clause 6.0 and Conditions of this Agreement, at any time, by giving notice in writing to Project Ski Ltd. Cancellation notices will only be accepted from the Client or booking agent.
6.2 In the event of Project Ski receiving a cancellation notice, for whatever reason, the Client shall forfeit payment as outlined below. (Payments are expressed as a percentage of the total booking cost.)
- More than 10 weeks before the holiday start date: 25% (deposit)
- Up to 8 weeks before the holiday start date: 50%
- Up to 4 weeks before the holiday start date: 75%
- Less than 4 weeks before the holiday start date: 100%
Note: If one or more guests wish to cancel their part of the booking, the other guests may be liable to pay a supplement to retain their booking.
6.3 If full payment has not been received by the due date, Project Ski Ltd. reserves the right to cancel the booking. Under such circumstances, Project Ski Ltd shall issue written notice of cancellation to the Client and retain any monies already received.
6.4 In the unlikely event that Project Ski Ltd. should cancel your booking for reasons other than those outlined in Clause 6.3 and from circumstances amounting to force majeure, and where we are unable to offer an alternative option of equal or more value, all monies which have been received, will be repaid in full.
7.0 Changes and Alterations by Project Ski Ltd.
We will notify you of any significant changes and alterations that may affect your booking. In circumstances where the changes are beyond our control, Project Ski Ltd. can not be held liable for any resultant loss.
8.0 Client Liability
8.1 Damage or loss to the accommodation and/or its grounds by the Client or any person invited to the accommodation by the Client and/or their guests is the Client’s responsibility. Please note, a damage deposit of 1000€ (claims not limited to this amount) will be taken on arrival in resort. In any case, where possible, damage or loss must be paid for at the time of the incident. If suitable payment can not be made at the time, we are entitled to recover the cost of any loss or damage caused by the Client and/or his/her guests.
8.2 By entering into a contract with Project Ski Ltd., the Client and their guests agree to behave in a way as not to prejudice Project Ski Ltd.’s reputation. If in our reasonable opinion, the Client or any one of their guests are deemed to be behaving in a way that will cause or is likely to cause danger, upset, damage or distress to any third party, we reserve the right to terminate their reservation with immediate effect and will have no further contractual obligations towards such person.
9.0 Project Ski Ltd. Liability
9.1 Project Ski Ltd. promise to provide, to the best of their ability the services which are included in the final cost, as described on our website or in writing,.
9.1.1 In the event that local restrictions or an injury or other enforced absence to one of more of our employees causes our normal service to be curtailed or restricted, this will not be accepted as cause for compensation claims.
9.1.2 Where Project Ski Ltd. act as an agent for the principal accommodation provider they can not be held liable for any issues or complaints in relation to the accommodation.
9.2 Project Ski Ltd. can not be held liable for any loss, damaged or stolen property as it is a condition of your booking to ensure you have suitable insurance to cover such circumstance.
9.3 Contracts between suppliers, other than Project Ski Ltd., and the Client, including those for the rental of any accommodation where Project Ski Ltd act as an agent, are exclusive between that supplier and the Client. Project Ski Ltd. therefore does not accept any liability for any loss or damage caused whilst these services are being provided.
9.4 Our liability is limited in all cases (except personal injury, illness and death) to the monetary value of any payment already received by Project Ski Ltd. from the Client.
In the unlikely event of a problem arising during your reservation, you must notify a member of Project Ski Ltd. staff as soon as possible and we will make every effort to rectify the problem. If you fail to do so, you deprive us of the opportunity to investigate and attempt to rectify the complaint.
If we are unable to resolve matters in resort, all formal complaints should be given in writing to Project Ski Ltd. Lodge Orchard, Doddington, Sittingbourne, Kent ME9 0HG or to email@example.com within 28 days of the last day of your booking.
If your reservation was made through an agent, you must follow their complaints’ procedure.
The terms of your booking and any claim relating to it or any matter arising out of this contract will be governed by English Law, and shall fall within the exclusive jurisdiction of the courts of England and Wales.
